This Acceptable Use Policy (the “AUP”) governs your use of the services operated by Callingly LLC (“Callingly”, “we”, “us”), including our web application, API, telephone numbers, voice calling, AI voice agents, and text messaging.
This AUP is incorporated into, and forms part of, the Callingly Terms of Service. It applies to every Callingly account, however that account was created — through our signup form, through a single sign-on provider, or through our API — and you accept it when you create an account and each time you use the service. It binds you, everyone you permit to use your account, and every end customer on whose behalf you place calls or send messages. If you do not accept it, you may not use the service.
Callingly places calls and sends messages at your direction and on your behalf. You are responsible for the legality of that traffic. Nothing in this AUP makes Callingly responsible for obtaining consent, maintaining your do-not-call lists, or determining whether a particular call or message is lawful.
You must have a lawful basis to contact every person you contact through Callingly, obtained before the call is placed or the message is sent. Where the Telephone Consumer Protection Act, its implementing rules, or any equivalent state or foreign law requires prior express consent or prior express written consent, you must hold consent of that kind and of that scope.
You must keep records evidencing consent for as long as applicable law requires and for at least five years, and you must produce them to us within 24 hours of our request. An inability to produce consent records on request is itself a violation of this AUP.
STOP, UNSUBSCRIBE, and equivalent opt-out keywords, and respond to HELP as carrier rules require.Do not place calls before 8:00 a.m. or after 9:00 p.m. at the called party’s local time, and observe any stricter limit imposed by state law or by the terms of the consent you hold.
Callingly applies an automatic check that withholds a call when the contact’s local time falls outside that window, using the time zone we derive from the contact’s telephone number. That check is a backstop, not a guarantee: where a number does not resolve to a time zone — a toll-free or other non-geographic number, for example — the check cannot apply, and the obligation above remains yours in full. Do not rely on it as your compliance control, and do not attempt to defeat it, including by supplying an incorrect time zone for a contact.
This section governs the caller ID presented to the person you are contacting.
You may dial only from a number Callingly has provisioned to your account or a number you have verified through our caller ID verification process. Attempting to present any other number to a contact is a violation of this AUP.
These rules do not govern the separate internal leg on which Callingly rings your own representatives to connect them to a waiting contact. Where your account has that option enabled, that leg may display the contact’s own number, so the representative can see who they are about to speak to before answering. The option is unavailable where local telephony rules prohibit presenting a caller ID you are not entitled to, and it is never a route to presenting a third party’s number to the person you are contacting.
Messaging traffic must comply with the CTIA Messaging Principles and Best Practices and with carrier A2P 10DLC requirements. You must register your brand and campaigns accurately, use each campaign only for the traffic it was registered for, and keep registration details current. Do not send content that carriers prohibit, including content relating to sex, hate, alcohol, firearms, or tobacco where prohibited, unlawful substances, or high-risk financial offers, except where we have approved that traffic in writing.
Do not use Callingly to:
Telephone carriers, the Industry Traceback Group, and regulators may ask us to identify the source of a call. When we pass such a request to you, or ask you for consent records, call detail, or campaign information relating to suspected unlawful traffic, you must respond within 24 hours and cooperate fully.
You agree that we may disclose your identity, account details, call records, recordings, and the information you gave us at registration to our upstream providers, the Industry Traceback Group, the Federal Communications Commission, the Federal Trade Commission, state attorneys general, and law enforcement, in connection with any traceback, complaint, or investigation.
We may monitor traffic on the platform for compliance with this AUP, including call volumes, call durations, answer and completion rates, caller ID reputation, complaint rates, and the rate at which terminating carriers block or label your calls. We do not undertake to monitor, and we are not responsible for traffic we do not detect.
Where we determine, in our reasonable discretion, that you have violated this AUP or that your traffic presents a risk of harm to recipients, to our carriers, or to the platform, we may take any of the following steps, with or without prior notice:
Where a violation is urgent — suspected unlawful robocalling, caller ID spoofing, fraud, or a request from a carrier or regulator — we will act first and notify you afterwards. Refunds following enforcement under this section are governed by section 8 of the Terms of Service. Nothing in this section limits any other remedy available to us under the Terms of Service or at law.
To report a call or message you believe was sent through Callingly in violation of this AUP, or to submit a traceback request, email [email protected]. Include the calling number, the called number, and the date and time of the call, and we will investigate.
We may update this AUP as law, carrier requirements, and industry practice change. We will post the revised policy here and update the date above. Your continued use of the service after a change takes effect constitutes acceptance of the revised policy.
